Where the order contains a mental health treatment requirement an individual must submit to treatment by or under the direction of a registered medical practitioner or a registered psychologist (or both) with a view to improving the offender’s mental condition.

Suitability is assessed within Justice Social Work Reports based on mental health assessment as to appropriateness for intervention and planned service provision. A Community Payback Order Mental Health Treatment Requirement requires a specialist mental health assessment and intervention. There will be individuals who already obtain, or require lower-level mental health support, through GPs or Community Mental Health Teams; this would be managed through the supervision requirement.
