Where the order contains a mental health treatment requirement an individual must submit to treatment by or under the direction of a registered medical practitioner or a registered psychologist (or both) with a view to improving the offender’s mental condition.

The mental treatment requirement is rarely used in Fife, and indeed Scotland, due to the very specific wording of the legislation and resource implications. Cases with mental health treatment requirements have been facilitated by the Community Forensic Mental Health Team. The Women’ Justice Team(s) in Fife have a dedicated NHS Team which includes a Clinical psychologist, assistant psychologist and mental health liaison nurse. However, in general, this support is offered on a voluntary basis when open to the Women’ Justice Teams on a variety of order types.
