Possible Outcomes

As per National Outcomes and Standards for Criminal Justice Social Work:

  1. Community safety and public protection
  2. The reduction of re-offending
  3. Social inclusion to support desistance from offending

In terms of Community Justice Outcomes, a Mental Health Treatment Requirement could contribute towards:

  • Effective Interventions are delivered to prevent and reduce the risk of further offending.
  • People have better access to the services they require, including welfare, health and wellbeing, housing and employability.
  • Life chances are improved through needs, including health, financial inclusion, housing and safety, being addressed.
  • Individuals’ resilience and capacity for change and self-management are enhanced.

Process for Assessment and/or inclusion in scheme/intervention

The Court will be informed through the Criminal Justice Social Work Report (CJSWR) of the individual’s suitability for such a requirement. Prior to the use of a Mental Health Treatment Requirement being referred to within the Criminal Justice Social Work Report, agreement will have been reached between support services locally to ensure that the requirement can be implemented effectively.

Where no specific scheme/intervention is available, is there capacity to provide a bespoke service based on judicial request?

Yes, via a Stand Down Report from the Aberdeenshire Court Social Worker (Aberdeen and Peterhead Sheriff Courts) or Criminal Justice Social Worker (Banff Sheriff Court).
Across Aberdeenshire there is access to mental health services and discussions would be held to ensure the type and frequency of contact with the service user is established prior to sentencing. Each individual will have a bespoke service tailored to meet individual need.
