Community Payback Order Treatment: Mental Health

Where the order contains a mental health treatment requirement an individual must submit to treatment by or under the direction of a registered medical practitioner or a registered psychologist (or both) with a view to improving the offender’s mental condition.

Further Information:

No specific national or local schemes are available. The Court will be informed through the Justice Social Work Report (JSWR) of the individual’s suitability for such a requirement. Prior to the use of a Mental Health Treatment Requirement being referred to within the Justice Social Work Report, agreement will have been reached between support services locally to ensure that the requirement can be implemented effectively.

If a Mental Health Treatment Requirement is not already referred to within the Justice Social Work Report, and the Court wishes to explore this as a sentencing option, a Stand Down Report can be provided from the Aberdeenshire Court Social Worker (Aberdeen and Peterhead Sheriff Courts) or Criminal Justice Social Worker (Banff Sheriff Court).

Across Aberdeenshire there is access to mental health services and discussions would be held to ensure the type and frequency of contact with the service user is established prior to sentencing. Each individual will have a bespoke service tailored to meet individual need.
