Community Payback Order Treatment: Drugs

Where the order contains a drug treatment requirement an individual must submit to treatment by or under the direction of a specified person with a view to reducing or eliminating the offender’s dependency on, or propensity to misuse, drugs.

No specific national or local schemes are available. The Court will be informed through the Justice Social Work Report (JSWR) of the individual’s suitability and readiness for such a requirement. Prior to the use of a Drug Treatment Requirement being proposed within the Justice Social Work Report, agreement will have been reached between support services locally to ensure that the requirement can be implemented effectively. Such a requirement would only ever be suggested where the individual is in agreement however, as both Community Substance Misuse Services and Clinic Substance Misuse Service acknowledge that a person within their service is more likely to be ‘ready to address change’ in their use of substances if they approach such services themselves, and not having been ‘instructed’ to by means of a legal Court Order. If a Drug Treatment Requirement is not already referred to within the Justice Social Work Report, and the Court wishes to explore this as a sentencing option, a Stand Down Report can be provided from the Aberdeenshire Court Social Worker (Aberdeen and Peterhead Sheriff Courts) or Criminal Justice Social Worker (Banff Sheriff Court).
