In accordance with National Outcomes and Standards and Community Payback Order Practice Guidance, Action Plans are developed using the appropriate risk assessment tools and plans implemented to reduce the risk of reoffending and address areas of need.

To make positive changes to their lifestyle whether that be practical change or changes in their personal development, attitudes and behaviour.

Suitability is assessed in the production of the CJSWR.

CPO with Restricted Movement Requirement (RMR)

Restricted Movement Requirement as requirement of CPO – Electronic monitoring is well established as a potential sentencing disposal assessed at Criminal Justice Social Work Report stage, via the Restriction of Liberty Order. In addition, the ability to impose a Restricted Movement Requirement (similar to an RLO) has been available as an additional requirement for a Community Payback Order (however only as a sanction for breaching the terms of the original Community Payback Order (CPO) and could not be imposed at first instance).

The introduction of the Restricted Movement Requirement on a Community Payback Order (CPO) at first disposal are recent (May 2022) changes for Justice Social Work Services. This requirement is similar to a Restriction of Liberty Order in that it allows an individual to be restricted to a particular place for up to 12 hours a day or restricted away from a particular place for up to 24 hours a day.

A Supervision Requirement (therefore requiring statutory Justice SW supervision) must be imposed in tandem when an RMR is imposed as part of a CPO. The Restriction of Liberty Order (RLO) remains available to the Court and can continue to be imposed as a stand-alone sentence or concurrent to a CPO.
