Bail Supervision

Male and Female, age 16+ who are at risk of remand to custody and have a presenting need which would require support.

Bail supervision schemes are designed to minimise the numbers of accused held on remand in custody pending trial or for reports after conviction, who subject to safeguards in respect of public safety, could be released on bail to the community pending their further court hearing (SG 2008).

Male and Female, age 16+ who are at risk of remand to custody. Contact is initially three times per week consisting of two office-based and one home visit.

Possible Outcomes

Reduce remand to custody and address health / addiction needs via referrals to community-based services. Increase awareness of local community services/organisations/activities to improve well-being and social inclusion if required.

Process for Assessment and/or inclusion in scheme/intervention

Consent agreed during assessment undertaken at Court by Social Work staff who approve intended address and risks associated with the individual i.e. mental health, physical health, compliance with current or previous orders.

Referrals are made to relevant community-based services when appropriate and intervention can include group work or 1:1 work if the individual consents.

Electronic Monitoring of Bail (EM Bail)

On 17th May 2022, Electronic monitoring of bail was introduced at Kilmarnock Sheriff Court. Electronic monitoring can provide assurance about the restriction of movement of a monitored person by imposing time and locational
limitations on the monitored person. The monitored person can, for example be monitored to help check that they remain in a specified place for a specified period (or be excluded from a specified place, at a specified time).

As previously noted, a person’s compliance with the terms of any condition is monitored by way of the person wearing a PID (commonly known as a “tag”) and the installation of a home monitoring unit. Possible Outcomes Reduce remand to custody

Process for Assessment and/or inclusion in scheme/intervention

When an individual appears from custody, either as a new case or a warrant, prosecutors will consider whether they will oppose an accused’s application for bail. Where time permits and as appropriate, JSW will provide an assessment to the court about the suitability of electronic monitoring as part of bail, to enable the court to make a decision on bail. In determining an application for bail, the court can determine whether
monitoring any bail condition electronically would provide them with additional assurance as to the appropriateness of bail and the management of any risk of an individual being on bail.
