Upon being placed on a Structured Deferred Sentence, Justice Social Work meet with the individual and agree an action plan (relevant to their offending and associated risks and needs) to be implemented for the duration of the SDS, e.g. an individual is to comply with Mental Health treatment and meet with Recovery Support Worker (Substances) on a fortnightly basis.

Possible Outcomes

Individual takes responsibility for themselves and comply with Action Plan, addressing issues and thereby reduce their own risk of reoffending.
A Structured Deferred Sentence provides an opportunity to test an individual’s motivation and resolve to address issues. It also provides a good indicator of ability to meaningfully engage with Community Disposals should they be further required. Should the Structured Deferred Sentence progress well there is the benefit of not requiring the use of a Community Payback Order to address risk and need.

Process for Assessment and/or inclusion in scheme/intervention

Direct request from Court imposition of Structured Deferred Sentence, normally following consideration of the suitability within a full Justice Social Work Report.
