Community Payback Order Treatment: Mental Health

Where the order contains a mental health treatment requirement an individual must submit to treatment by or under the direction of a registered medical practitioner or a registered psychologist (or both) with a view to improving the offender’s mental condition.

Specific interventions can be made available via NHS Highland and local mental health teams for individuals who are assessed as suitable for a mental health treatment requirement. For a mental health treatment requirement to be imposed under a CPO the court has to gain evidence from a registered medical practitioner that the individual suffers from a mental health condition that does not meet the requirement for compulsory treatment, and that their condition may be susceptible to treatment. Psychiatric and Criminal Justice Social Work Reports are required.
