Structured Deferred Sentence

Structured deferred sentence is utilised to provide social work support to individuals who may need a short term intervention to address needs but who do not require the level of supervision of a Community Payback Order. Support offered is based on assessed risk and needs and a case management plan will be included in the Criminal Justice Social Work Report. Referrals are made to commissioned or universal services dependent on needs.
Also, rather than a further period of deferral for a Spousal Assault Risk assessment, Falkirk Justice Services may request a structured deferred sentence be imposed at the first calling of a Criminal Justice Social Work Report to provide time for a social worker to undertake a piece of work with an individual to fully assess suitability for a Community Payback Order with programme requirement. An updated report would be made available at the next calling of the structured deferred sentence outlining the individual’s response to the period of deferment, level of engagement with the social worker and recommendations on options such as a Community Payback Order to inform sentencing at the end of the deferral period.
Support will be provided to address identified areas of risk/needs as per the identified case management plan with a view to informing sentencing at the end of the deferral period.
Process for Assessment and/or inclusion in scheme/intervention
Assessment for suitability is carried out by Justice Service social workers via a Criminal Justice Social Work Report.
